The meeting was called to order at 7:30 p.m. by Chairman Steven Patton.

WATER BILL APPEAL - 40 SOUTH MAIN STREET

Minutes from the 03/09/09 meeting:

“Mr. Himes explained that on July 11, 2008 the Utilities Department was making a service call at 40 South Main Street and they found a sub-meter that was plumbed in on the street side of the utility meter, so there was a meter set up to plum an apartment and was plumed in prior to the water going through the meter that we are reading for billing purposes. There is no record in our billing record or reading record of this meter being read. We do allow sub-metering but it all has to be passed the meter we are reading for utility billing purposes. The owner was then billed for all the consumption that was recorded on that meter. For both water and sewer service it amount to $14,686.74. The water department plumed in a new meter and it is now on the billing system.”

“Mr. Williams said he would suggest that Mr. Himes look at what other comparable usages are and begin there in terms of trying to figure out what appropriate relief may be. He asked that Mr. Himes look at the history and come up with some alternative method of calculating what appropriate usage is and then carry the conversation forward from there.”

Mr. Himes said he searched the meter record for meters on either side of that serial number to see if it came out of our system but could not find any meters that were in that vicinity. The meter was read on November 17, 2008 and it had 800 cubic feet on it and then it was read again on March 10, 2009 with still 800 cubic feet on it. He said Ms. Carter in the water department was under the impression that the property was vacant but Mr. Hughes said he has had a tenant in there the whole time so they may have a problem with the new meter that is in there.

Regarding comparable usage, Mr. Himes said he went back and calculated, based on average quarterly usage for a single-family home, and he took that and divided it by the average population per home, which is 2.1 persons per home, and that worked out to 1,240 cubic feet per quarter. Over the total 14 year life if you use that figure it came out to about 70,000 cubic feet rather than the 143,000 cubic feet that has accumulated on the meter so roughly half of what the meter shows as accumulated usage.


After discussion, Mr. Williams suggested that they postpone this so that they can continue to research it.

Mrs. Evans said I need to recuse myself from this discussion because Mr. Hughes and I are partners in a building in Solon.

The meeting adjourned at 7:45 p.m.
