VILLAGE OF CHAGRIN FALLS
STORM WATER COMMITTEE

The meeting was called to order at 7:00 p.m. by Chairman Steven Patton.
COMPREHENSIVE STORM WATER ORDINANCE
Mr. Himes said when we adopted our overall Village Storm Water Management Plan to comply with the Phase II Storm Water Regulations, part of that plan was to have a comprehensive storm water management ordinance on the books. The Chagrin River Watershed Partners developed this after much research and going around with the EPA and various soil and water conservation groups.
What everyone has is the Chagrin River Watershed Partners’ model that conforms to the Village. This goes hand and hand with the erosion and sediment control ordinance that we passed late last year. That ordinance dealt with storm water sediment and erosion while a site was under construction and this deals with a site after it is built. It provides for water quality, volume, and rate of runoff and uses storm water management practices to control those things to reduce flooding and erosion. It is applicable only to sites that disturb more than one acre of soil either on their own or as a part of a larger development. If you have a single lot in a subdivision that is only disturbing a quarter of an acre, because it is part of a subdivision that as a whole is disturbing more than an acre they have to comply. This requires a developer to design a comprehensive storm water management plan that he has to submit to the engineer and also has to comply with state and federal regulations.
The plan describes how the storm water is going to be managed after construction is completed and how they are addressing water quality, quantity, and volume issues. It has to be prepared by a professional engineer and then the Village’s engineer reviews it. They submit plans and drawings with this that show where these storm water control structures or sediment ponds are. It also requires an inspection and maintenance agreement, which for a subdivision would be with the homeowners association. The property owners have to have some kind of maintenance agreement where they assume responsibility for maintaining these structures and will inspect them on a regular basis and take care of them over the life of the structure.
Mr. Himes went on to explain the different sections of the ordinance and there was further discussion. Comments were heard and questions were answered.
Mr. Himes mentioned that some drafts show that the bond amount is $1,500, under 1357.15, and it needs to be amended to $15,000.
Moved by Mr. Patton, seconded by Mrs. Skeel that the Storm Water Committee recommend to Council that they adopt the Comprehensive Storm Water Ordinance with the understanding that the amount of the bond is $15,000 per acre as opposed to $1,500 per acre, under section 1357.15. The motion carried unanimously.
DOWN SPOUT CONNECTIONS
Mr. Himes said our current ordinance for down spout connections says that all roofs and drains will go to a public storm sewer if available. We have read that as meaning if available on the lot, so, if a property has a connection to the existing storm sewer, to have that on the lot, then they can connect to it, otherwise, we allow them to discharge on to splash blocks. The water then travels across their yard, finds its way to the street, and eventually gets into the storm sewers.
Mr. Himes said he brought this up to see if the Committee wants to change the way they are enforcing this or change the way the code reads.
Mr. Tomko suggested giving people the option instead of tying into the storm sewer using a french drain, which would accomplish a lot of what we want to do, which is onsite disposal of the water. Mr. Himes said they have done that and allowed infiltration type galleries where if someone needs to get it in the pipe and away from the house we allow them to do that as long as they dig out an infiltration pit with gravel.
The Committee agreed to let things remain as is.
