The meeting was called to order at 6:45 p.m. by Chairman Janna Lutz.

NOISE ORDINANCE

Mr. Himes explained that this is before the Safety Committee because the Spillway Project is going in on the old Ivex property. There has been a lot of discussion with the neighbors and the Planning Commission about noise and how to best regulate that. The Village currently has noise ordinances both in the general offenses and in the zoning code but he has been advised in the past that they are largely unenforceable. The Planning Commission felt it was probably best addressed not to ad-hock in each zoning classification but to have an overall umbrella noise ordinance. The law director was asked to look at the noise ordinance and propose a new ordinance that would cover all districts.

Mr. Himes, along with Mr. Byron and the Committee, reviewed and discussed the proposed ordinance. Comments were heard and questions were answered.

Mr. Himes said because this does contain a change to the zoning regulations, there will be three readings at Council and there will be a public hearing for that portion.

Moved by Mrs. Lutz, seconded by Mrs. Evans that Council pass this legislation as written pending approval by P&Z on Section 1144. Carried. Ayes: Lutz, Watteson, Evans. Nays: None.

The meeting adjourned at 7:00 p.m.
